Sublease Agreement in California

For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.

What California law says

Subletting rulesNo statute — lease controls for residential leases. California's statutory consent rules for assignment and subletting (Civil Code §§ 1995.010–1995.340, including the implied 'not unreasonably withheld' standard) apply only to leases for other than residential purposes.
Some local rent ordinances add rules on replacement roommates and subtenants.
