Sublease Agreement in Delaware
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Delaware law says
| Subletting rules | Unless otherwise agreed in writing, a tenant may sublet or assign. A lease may restrict or prohibit assignment in any manner, but may restrict subletting only by requiring the landlord's consent, which may not be unreasonably withheld; the landlord bears the burden of showing a refusal was reasonable.
