Sublease Agreement in Hawaii
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Hawaii law says
| Subletting rules | Unless a written rental agreement says otherwise, a tenant may sublet the unit or assign the rental agreement without the landlord's consent. A written rental agreement may require the landlord's consent. The default rule does not apply to units administered, owned, or subsidized by the federal, state, or county government. The statute sets no reasonableness standard when the lease requires consent. Source: HRS s. 521-37 |
