Sublease Agreement in Idaho
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Idaho law says
| Subletting rules | No statute requiring or limiting landlord consent — the lease controls. If a tenant assigns or sublets in violation of the lease, the lease terminates and the landlord may recover possession after serving a 3-day notice to quit. Breach of a no-assignment or no-sublet covenant is also listed among lease-covenant breaches that support an unlawful detainer after a 3-day notice to perform or quit (s. 6-303(3)).
