Unemployment Appeal Letter in Idaho
A letter appealing a denial of unemployment benefits. Appeal deadlines are short and strict in every state — file before the deadline shown below, even if you are still gathering documents, and keep claiming benefits each week while the appeal is pending if your state allows it.
What Idaho law says
| Appealing a denial | Submit a written protest to the Idaho Labor Appeals Bureau within 14 calendar days of the determination's mailing date, following the instructions on the determination. Keep filing weekly certifications and attend the telephone hearing if one is scheduled. If you do not protest, the determination becomes final. |
|---|---|
| If you were fired | You are denied benefits if you were discharged for workplace misconduct connected with your employment, and the employer has the burden of proving it. An indefinite unpaid suspension with no return date is treated as a discharge. To requalify, you must get bona fide work and earn at least 14 times your weekly benefit amount. |
| If you quit | You are denied benefits if you quit without good cause connected with your employment. Good cause comes from working conditions, job tasks or the employment agreement and must be real, substantial and compelling to a reasonable person; personal reasons do not qualify. Recognized reasons include serious moral or ethical objections to work requirements, a health condition that makes the job impossible to do, unlawful harassment, leaving to escape domestic violence, following a military spouse on a permanent move, and moving from temporary to permanent work or to more hours. Voluntarily retiring or leaving during a downsizing when suitable work continues counts as a personal-reason quit. To requalify, you must earn at least 14 times your weekly benefit amount in new work. Source: Idaho Code § 72-1366(5), (14) |
