Sublease Agreement in Maryland

For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.

What Maryland law says

Subletting rulesNo statute — lease controls. Maryland's landlord-tenant law does not set a consent standard for a tenant to sublet or assign. If a tenant wrongfully abandons or never takes possession, the landlord may sublet the unit without prior notice, and the tenant stays secondarily liable for rent if the landlord gives prompt notice of any default by the subtenant.
