Sublease Agreement in Montana
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Montana law says
| Subletting rules | Landlord's written consent required. A tenant who vacates during the tenancy may not transfer possession to a third person or sublet the unit unless the landlord or the landlord's agent has consented in writing. The statute sets no reasonableness standard for the landlord's decision. Under the Act's definitions, a subtenant with a sublease made with the landlord's written approval and under the rental agreement is treated as a tenant (§ 70-24-103). Source: Mont. Code Ann. § 70-24-305 |
