Henderson Landlord-Tenant Rules

Henderson adds local rules on top of Nevada landlord-tenant law. Here is what is different, with the city code or agency page behind each rule.

Eviction diversion/assistanceSince February 2, 2026, the Eviction Diversion Program (EDP) has covered Henderson Justice Court. It is for tenants aged 62 or older, or tenants receiving SSI because of a disability, who face eviction for nonpayment of rent and who file a tenant answer within the notice period. Eligible tenants and their landlords get rental assistance through Clark County Social Services, and a Legal Aid Center of Southern Nevada lawyer represents the tenant. The answer forms are on the Civil Law Self-Help Center website (civillawselfhelpcenter.org/forms).
This is a county and court program, not a City of Henderson ordinance.
Tenant right to counselThere is no general right to counsel. Through EDP, a Legal Aid Center of Southern Nevada lawyer represents eligible tenants 62 or older or on SSI disability who face nonpayment eviction. Otherwise, contact the Legal Aid Center of Southern Nevada at (702) 386-1070.
State preemptionNo Nevada statute expressly barring cities from adopting rent control or other tenant protections was found. Nevada cities have home-rule power only over 'matters of local concern', which excludes matters needing statewide uniformity and business activities already substantially regulated by the state.

Eviction cases in Henderson are heard in: Henderson Justice Court (Henderson Township), 243 S. Water St., Henderson, NV 89015
