Sublease Agreement in New Hampshire

For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.

What New Hampshire law says

Subletting rulesNo statute — lease controls. New Hampshire sets no consent standard for subletting. A 'subtenant' is defined as someone who rents from a tenant who has the landlord's authorization to sublet. An occupant who claims to be a subtenant or implied tenant must prove it; if the lease prohibits subletting and the occupant cannot show implied-tenant status, the occupant can be removed through the RSA 540-A:4 petition process.
An 'implied tenant' occupies the unit with the knowledge and consent of both the tenant and the landlord, without a signed lease.
