Last Will and Testament in Oklahoma

A simple will form for straightforward estates. A will is valid only if it is signed and witnessed exactly as your state requires (below); one that is not executed correctly may be ignored by the court. Larger estates, blended families, trusts for minor children or business interests are worth a lawyer's review.

What Oklahoma law says

Requirements for a valid willAny person over 18 who is of sound mind may make a will. Except for holographic (handwritten) and nuncupative (oral) wills, the will must be in writing and signed at the end by the testator (or by someone else in the testator's presence and at his or her direction). The testator must sign in front of the witnesses or acknowledge the signature to them, and must declare to them that the document is his or her will. Two attesting witnesses must sign at the end of the will, at the testator's request and in the testator's presence. A person under a guardianship or conservatorship may still make a will, but it must be signed and acknowledged in the presence of a district judge.
Each witness should also write his or her place of residence, but leaving it off does not make the will invalid.
Self-proving affidavitYes. A witnessed will (or a codicil) may be made self-proved at signing or later while the testator and witnesses are alive, either by the testator's acknowledgment and the witnesses' affidavits before a notary or other officer using the statutory certificate, or by written declarations of the testator and witnesses signed under penalty of perjury in the statutory form (no notary needed). A self-proved will is admitted to probate without witness testimony unless it is contested.
Section 55 was amended effective January 1, 2026 (2025 Okla. Sess. Laws ch. 486), which updated the criminal penalty for falsely signing a witness declaration.
Handwritten (holographic) willsYes. A holographic will is valid if it is entirely written, dated and signed in the testator's own handwriting. No witnesses are required, and it may be made in or out of Oklahoma.
