Power of Attorney (Financial) in Oregon
A financial power of attorney lets you name an agent to handle money and property for you. Many states have their own statutory form and signing rules (notary, witnesses), and banks often ask for that form. Check your state's rules below; if your state has a statutory form, use it.
What Oregon law says
| Power of attorney signing rules | Oregon's power of attorney statutes (ORS 127.002 to 127.045) contain no statutory form. A written power of attorney is durable by default: unless it says otherwise, it takes effect when signed and keeps working if the principal becomes financially incapable. It may instead take effect at a future time or event, such as incapacity determined by a designated person or a physician. A deed signed by an agent must be acknowledged to be recorded. ORS 127.002 to 127.045 do not state witness or notary requirements for a financial power of attorney. Source: ORS 127.005, 127.015; ORS 93.010 |
