Sublease Agreement in South Dakota

For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.

What South Dakota law says

Subletting rulesNo statute — lease controls. South Dakota's lease chapter does not set a landlord-consent standard for subletting or assignment. If a lease is assigned, the landlord has the same remedies against the assignee (for breaches while the assignee holds the lease, and for recovery of possession) as against the original tenant.
