Rental Application in Texas
A rental application that collects what landlords commonly ask for. Follow your state's limits on application fees and fair-housing rules: ask every applicant the same questions.
What Texas law says
| Application / screening fees | No cap on application fees. Landlord must make printed tenant-selection criteria available with the application, and the applicant signs an acknowledgment; if the landlord rejects an applicant without having made the criteria available, it must refund the application fee and any application deposit. An applicant not accepted within 7 days is deemed rejected (application deposits refundable). Bad-faith failure to refund: $100 + 3 times the amount wrongfully retained + attorney's fees. No portable screening report law. Waivers in the rental application are void (Sec. 92.355). |
|---|---|
| Statewide ban on refusing Section 8 / source of income | No. There is no statewide source-of-income protection, and cities and counties are barred from adopting ordinances that prohibit refusing a tenant because the tenant's income includes federal housing assistance (e.g., Section 8 vouchers). Local protections for veterans' income and voluntary voucher-incentive programs are still allowed. |
