Hiring a Child Custody Lawyer in Missouri
How courts in Missouri decide custody, emergency custody, parenting classes, how to check a lawyer's license, and free or low-cost family law help. We do not recommend or rank lawyers.
What a lawyer costs in Missouri: fee rules
| If you disagree with a lawyer's bill | The Office of Chief Disciplinary Counsel refers fee complaints to the Fee Dispute Resolution Committees operated by The Missouri Bar. |
|---|---|
| If a lawyer takes your money | The Missouri Bar's Client Security Fund, created in 1966 and maintained by Bar members' annual fees, can compensate clients harmed by a lawyer who has been disbarred, suspended, ruled mentally incapacitated, or has died. Fee disputes and malpractice are not covered. File within two years of discovering the loss using the Client Security Fund Claim Form on MissouriLawyersHelp.org (or request a printed copy from the fund coordinator). A committee recommends full or partial payment or denial, the Board of Governors has final discretion, and the committee aims to decide claims within a year. |
Missouri rules to know first
| How custody is decided | Custody is decided by the child's best interests. There is a rebuttable presumption that equal or approximately equal parenting time for each parent is in the child's best interests; it can be rebutted by a preponderance of the evidence, if the parents agree on all custody issues, or if there is a pattern of domestic violence. When parents do not agree, the court must make written findings on factors including the parents' wishes and proposed parenting plans; the child's need for a frequent, continuing and meaningful relationship with both parents; the child's relationships with parents, siblings and others; which parent is more likely to allow contact with the other parent; the child's adjustment to home, school and community; the mental and physical health of everyone involved, including any history of abuse; any intention to relocate; and the unobstructed input of the child, free of coercion and manipulation. No specific age is set for the child's input. Custody or unsupervised visitation may not be given to a parent (or someone living with them) found guilty of listed offenses against a child. | Parenting classes | Yes, generally. In a divorce or legal separation involving minor children, or a later case deciding custody, the court must order the parties to attend educational sessions on the effects of custody and divorce on children, unless there is good cause (for example, the parties agreed on custody and visitation, or attending would endanger a party or child) or local court rule provides otherwise. The court may also order children to attend age-appropriate sessions. What is said in the sessions is not used in deciding the case. Source: RSMo §§ 452.605, 452.607 |
| Grandparents' rights | A court may grant reasonable grandparent visitation if the grandparent has been unreasonably denied visitation for more than 60 days and: the parents have filed for divorce (grandparents may intervene on visitation); one parent has died and the surviving parent denies visitation to the deceased parent's parents; or the child lived in the grandparent's home for at least 6 months within the 24 months before filing. Grandparents generally may not file if the parents are married and living together with the child. Visitation must be in the child's best interests, the court may consult the child, and rights may end if the child is adopted. Source: RSMo § 452.402 |

| Lawyer referral service | The Missouri Bar offers LawyerSearch, a directory of lawyers who have chosen to be listed, searchable by area of practice or Missouri county, with optional language-assistance filters; it is not described as a referral service, and "Inclusion on this list does not constitute an endorsement by The Missouri Bar of particular attorneys." In the St. Louis area, the Bar Association of Metropolitan St. Louis sponsors a Lawyer Referral and Information Service (bamsl.org). Missouri Bar phone: (573) 635-4128. | Check discipline history or file a complaint | Complaints about Missouri lawyers go to the Office of Chief Disciplinary Counsel (OCDC) in writing, using the online form, a printed or fillable PDF form, or a letter, one complaint per attorney (OCDC cannot investigate law firms). Mail: OCDC, 3327 American Ave, Jefferson City, MO 65109; phone 573-635-7400. Include the lawyer's name and address, the legal matter, any court and case caption, a detailed statement of facts, and documents such as fee agreements and proof of payment. There is no cost. Staff Counsel reviews complaints in order and tries to respond in writing within about four weeks; if a file is opened, the lawyer is usually notified and may respond, and you may reply. OCDC cannot give legal advice or recover money for you. A list of public discipline imposed since January 1, 2006 is posted by the Missouri courts.
