What a lawyer costs in West Virginia: fee rules
| Rules on contingency fees | Under West Virginia Rule of Professional Conduct 1.5(c), a contingent fee agreement must be in a writing signed by the client stating how the fee is determined, including the percentage(s) for settlement, trial or appeal; litigation and other expenses deducted from the recovery; and whether expenses are deducted before or after the fee is calculated. It must clearly notify the client of expenses owed whether or not the client prevails, and at the end the lawyer must give a written statement of the outcome and, if there is a recovery, the remittance and how it was determined. Rule 1.5(d) bars fees in domestic relations matters contingent on securing a divorce or on the amount of alimony, support or property settlement, and contingent fees for defending a criminal case. |

| If you disagree with a lawyer's bill | The West Virginia State Bar's Voluntary Fee Dispute Resolution Program helps clients and lawyers work out disagreements over fees or costs; either side can start it. An attorney member of the District Grievance Committee living in the claimant's county contacts both parties to try to resolve the dispute, ideally within 30 days. Send a description of the dispute and relevant documents to the State Bar's Executive Director at director@wvbar.org or 2000 Deitrick Blvd., Charleston, WV 25311. |
| If a lawyer takes your money | The West Virginia State Bar's Lawyers Fund for Client Protection reimburses losses caused by dishonest conduct (theft, embezzlement, wrongful conversion, refusing to refund unearned advance fees, or borrowing from a client without intent to repay) of West Virginia lawyers within a lawyer-client or fiduciary relationship. Losses of the lawyer's family, partners, associates or employees, losses covered by bonds or insurance, and government losses are excluded. Under the Fund's rules, awards are capped at $20,000 per claim and $40,000 per attorney per year (subject to change by the Board of Governors), excluding interest and incidental expenses. File within two years after you knew or should have known of the dishonest conduct and the loss, using the Fund's application form; questions 304-553-7220. West Virginia rules to know first
| Getting a court-appointed lawyer | An applicant completes the financial affidavit prescribed by Public Defender Services, which serves as the application for publicly funded representation. Eligibility is determined (by the trial court administrator's office, a designated public defender office employee, or a circuit judge) under financial eligibility guidelines set by the agency, considering factors such as income prospects, liquid assets, fixed debts, family members' age or infirmity, efforts to obtain private counsel, the cost of private counsel and bail arrangements. Representation may not be denied unless the person can obtain counsel without undue financial hardship. After an adverse judgment, the court may order repayment of appointed counsel's compensation and expenses only if the person can pay without undue hardship. Source: W. Va. Code § 29-21-16 |

| Bail and release before trial | A person charged with an offense not punishable by life imprisonment shall be admitted to bail by the court or magistrate; for an offense punishable by life imprisonment, bail is in the discretion of the court that will try the offense. A judicial officer shall release a person charged with a misdemeanor on his or her own recognizance except for good cause shown, but this presumption does not apply to misdemeanors involving violence or threats, a minor victim, a deadly weapon, controlled substances, sexual abuse, specified DUI-related offenses, or auto tampering, petit larceny or stolen property over $250. Otherwise the person is entitled to bail on the least restrictive conditions needed to assure appearance and public safety (such as supervision, home incarceration or electronic monitoring, no-contact orders, a cash bond or a bail bond with sureties). Factors include ability to pay, the nature and number of offenses, potential penalty, violence, prior record, character, health, residence, reputation, strength of the evidence, pending release status and past bail forfeitures. Cash bail for misdemeanors may not exceed three times the maximum fine. A person held on a misdemeanor because he or she cannot meet a secured bond must get a hearing within five days of the initial bail setting. The bail amount or a denial of bail may be challenged by summary petition to a higher court. Release types and conditions: https://code.wvlegislature.gov/62-1C-1a/ Source: W. Va. | Felony classes and sentences | West Virginia does not sort felonies into numbered classes or degrees in its general provisions. Offenses are either felonies or misdemeanors: offenses punishable by confinement in the penitentiary are felonies, and all other offenses are misdemeanors. The prison term and fine for each felony are set in the statute defining that crime (for example, grand larceny: 1 to 10 years, or in the court's discretion up to 1 year in jail, and a fine of up to $2,500).
