Cars and repairs

New car lemon lawOklahoma's lemon law covers new motor vehicles that must be registered in Oklahoma, up to 10,000 pounds gross vehicle weight, plus recreational vehicles of any weight. If the consumer reports a defect directly in writing to the manufacturer, its agent or dealer during the express warranty or within one year of delivery, whichever ends first, the manufacturer must make the needed repairs. If a defect that substantially impairs the vehicle's use and value cannot be fixed after a reasonable number of attempts, the manufacturer must either take the vehicle back and refund the full purchase price including taxes and government fees (but not interest), minus a use allowance, or replace it with a comparable new model the consumer accepts. A reasonable number of attempts is presumed if the same defect was subject to repair four or more times, or the vehicle was out of service for a cumulative 30 business days, within the warranty term or one year; the manufacturer must first receive direct written notice and a chance to fix it. If the manufacturer has a qualifying informal dispute program, the consumer must use it before seeking a refund or replacement. A consumer who wins in court recovers costs and reasonable attorney fees.
The use allowance is calculated from miles driven beyond 15,000, as set out in the statute.
How to file a lemon law claim1) Written report: the consumer must report the defect directly in writing to the manufacturer, its agent or an authorized dealer during the express warranty term or within one year after original delivery, whichever ends first. 2) Written notice to the manufacturer: the presumption that the manufacturer had a reasonable number of repair attempts does not apply unless the manufacturer received prior direct written notice from or on behalf of the consumer and had an opportunity to fix the defect. 3) Arbitration: if the manufacturer has an informal dispute settlement procedure that complies in all respects with federal rules (16 C.F.R. part 703), the consumer must use it first before the refund-or-replacement remedy applies. The law does not create a state-run arbitration program or set a consumer fee. The Attorney General must post a written statement of buyers' rights on its website, and dealers must give it to buyers at purchase. 4) Lawsuit: a consumer who wins a civil action recovers all costs and reasonable attorney fees. The lemon law section does not state a specific deadline to file a claim or lawsuit.
Auto repair rulesOklahoma's Aftermarket Crash Parts Regulation Act says a repair shop or insurer may not use or specify non-original-manufacturer replacement body parts in a vehicle repair unless the consumer is told in writing; the written estimate must identify each such part and include a disclosure about who provides the warranty for those parts.
This covers only aftermarket crash (body) parts; no general Oklahoma statute on repair estimates or authorizations was located.

Buying and contracts

Right to cancel (cooling-off)Under Oklahoma's Consumer Credit Code, a buyer may cancel a home solicitation sale until midnight of the third business day after signing. The rule covers consumer credit sales of goods (other than farm equipment) or services that are personally solicited at the buyer's home, where the buyer agrees there. Notice must be written and is effective when mailed. The contract must include a "BUYER'S RIGHT TO CANCEL" statement. The seller must return payments within 10 days after cancellation but may keep a cancellation fee of up to 5% of the cash price, not exceeding the cash down payment. The right does not apply when the buyer asked for goods or services without delay because of an emergency and the seller has substantially begun performance.
This state rule applies to consumer credit sales; the federal FTC cooling-off rule may also apply to other door-to-door sales.
Gift cardsA gift certificate or gift card may not be sold with an expiration date less than 60 months (five years) from the date of purchase, and generally may not carry service or dormancy fees. A card sold without an expiration date is valid until redeemed or replaced. A limited dormancy fee of up to $1 per month is allowed only if the card has $5 or less left, has had no activity for 24 consecutive months, can be reloaded, and the fee is disclosed on the card. Promotional or loyalty cards given without payment, discounted cards sold for fundraising, and cards for food products are exempt if the expiration date is printed in capital letters on the front.
Price gougingUnder Oklahoma's Emergency Price Stabilization Act, during a state or federal emergency declaration and for 30 days afterward, no one may sell, rent or lease, or offer, goods, services, dwelling units or storage space in the emergency area at more than 10% above the price charged immediately before the declaration, unless the increase is due to petroleum or natural gas market price increases or to factors unrelated to the emergency (not added profit). For 180 days after that, the same 10% limit applies to renting dwelling units or storage space and to selling goods used to repair, restore, remodel or build homes in the emergency area. The emergency area includes the affected counties and all neighboring counties. A violation is a violation of the Consumer Protection Act, and actions may be filed within one year after the emergency declaration ends.
Home improvement contractorsRoofing contractors must register annually with the Construction Industries Board, and it is unlawful to act as a roofing contractor without a current registration (commercial roofers also need an endorsement). When a homeowner signs a contract with a residential contractor to be paid from a property insurance claim, the homeowner may cancel within 72 hours after receiving written notice from the insurer that all or part of the claim was denied; the contractor must give a written cancellation notice, and payments must be returned within 10 business days after cancellation.
No general statewide home improvement contractor licensing statute was located; local rules may apply.

Credit, scams and data

Unfair and deceptive practices lawThe Oklahoma Consumer Protection Act lists unlawful practices in consumer transactions, such as knowingly misrepresenting a product's brand, source, sponsorship, approval or certification, and other deceptive and unfair trade practices. An aggrieved consumer has a private right of action for actual damages, litigation costs and reasonable attorney's fees. If the violation is also found to be unconscionable, the court may award the consumer a civil penalty of up to $2,000 per violation in an individual action. A court may order a party that brought a bad-faith or groundless claim or defense to pay up to $10,000 of the other side's costs and fees.
Credit repair and debt settlement companiesCredit services organizations (credit repair companies) must be licensed by the Administrator of Consumer Credit. They may not take payment before fully performing the promised services unless they have a $10,000 surety bond and an in-state trust account, and may not make or advise untrue statements to credit bureaus or creditors or use misleading representations. Contracts must be written, list all payments and services, and tell the buyer they may cancel before midnight of the fifth day after the transaction, with an attached notice of cancellation form.
Data breach noticeA business or other entity that owns or licenses computerized personal information must notify Oklahoma residents, without unreasonable delay, when their unencrypted and unredacted personal information was or is reasonably believed to have been accessed and acquired by an unauthorized person and this has caused or is reasonably believed will cause identity theft or other fraud. Personal information includes a name combined with a Social Security number, driver license or other government ID number, financial account or card number with its access code, or biometric data. Beginning January 1, 2026, the entity must also notify the Attorney General within 60 days after notifying residents, unless fewer than 500 residents are affected (fewer than 1,000 for a credit bureau).
