| Right to cancel (cooling-off) | Under Oklahoma's Consumer Credit Code, a buyer may cancel a home solicitation sale until midnight of the third business day after signing. The rule covers consumer credit sales of goods (other than farm equipment) or services that are personally solicited at the buyer's home, where the buyer agrees there. Notice must be written and is effective when mailed. The contract must include a "BUYER'S RIGHT TO CANCEL" statement. The seller must return payments within 10 days after cancellation but may keep a cancellation fee of up to 5% of the cash price, not exceeding the cash down payment. The right does not apply when the buyer asked for goods or services without delay because of an emergency and the seller has substantially begun performance. This state rule applies to consumer credit sales; the federal FTC cooling-off rule may also apply to other door-to-door sales. |
