Warranty Deed in Alabama

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What Alabama law says

Signing and recording a deedA deed must be in writing and signed by the grantor or an agent with written authority, and attested by one witness (two if the grantor signs by mark or someone else writes the name); a notary acknowledgment satisfies the witness requirement. Deeds are recorded with the county judge of probate, and the probate judge will not record a deed unless it shows the name and address of the person who prepared it. A deed tax of $0.50 per $500 of value must be paid before recording, and the deed must be accompanied by proof of the actual purchase price or value (the Department of Revenue's form may be used).
