Concord Landlord-Tenant Rules
Concord adds local rules on top of California landlord-tenant law. Here is what is different, with the city code or agency page behind each rule.
| Rent control | Concord's Residential Tenant Protection Program caps rent increases at 5% per year for covered units: rented apartments in multifamily complexes built before February 1995, and rented mobile home units. Only one annual increase is allowed in any 12-month period, the unit must be registered with fees paid before any increase, and unused increases cannot be banked. When a tenant moves out voluntarily or is lawfully evicted, the landlord may set any rent for the next tenant. Single-family homes, condos, accessory dwelling units and buildings with a certificate of occupancy after February 1, 1995 are not under the rent cap. Ordinance text: https://www.cityofconcord.org/DocumentCenter/View/13063. The 5% cap replaced the earlier cap of 60% of CPI, up to 3%. Tenants and owners can file rent adjustment petitions. |

| Just-cause eviction | Landlords of covered units need a stated for-cause or no-fault reason to end a tenancy. For-cause reasons include nonpayment of rent, breach of the lease after written notice, nuisance, waste, refusing to sign a similar lease renewal, criminal activity or threats, unauthorized subletting, refusing lawful entry, and illegal use. No-fault reasons are owner or family move-in, Ellis Act withdrawal, government orders, and demolition or substantial remodel. Owner move-in is not allowed against a senior, disabled or terminally ill tenant who has lived there at least three years, unless the incoming owner or relative is also in one of those groups. Just cause applies to apartments (including those built after 1995) and to single-family homes and condos when the landlord rents out three or more in Concord; landlords with two or fewer rented homes or condos are exempt. Landlords must file a copy of every termination notice through the City's rent registry portal within 7 calendar days of serving it (Sec. 19.40.060(e)). | Relocation assistance | For a no-fault eviction from a covered apartment (owner move-in, Ellis Act, government order, or demolition), the landlord must pay, regardless of income, three times the HUD Fair Market Rent for a similar-size unit plus a $3,000 moving stipend. If any tenant in the unit is a protected tenant (lower-income, disabled, senior, terminally ill, or with school-age children), the household gets one more month of HUD Fair Market Rent. For a covered single-family home or condo, the landlord pays two months of current rent plus a $2,000 moving stipend. Half is due within 15 days of the termination notice and the rest by move-out. Tenants displaced temporarily by a substantial remodel get a per diem payment or comparable housing. The landlord must also refund the security deposit, less properly itemized deductions. | Written lease requirement | For covered units, the landlord must offer a prospective tenant a written lease with a minimum term of one year. If the tenant rejects the one-year lease in writing, shorter minimum terms apply. Landlords who rent two or fewer single-family homes or condos in Concord are not subject to minimum lease terms. | Rental registration | Every rented home in Concord, regardless of size or type, must be registered each year through the City's rent registry portal. FY 2025-26 fees per unit: $78 for fully covered units, $50 for partially covered units (just cause only), and $33 for registry-only units. Single-family and condo registration ran February 1 to March 31, 2026; multifamily and mobile home registration ran May 1 to June 30, 2026.
