California Notice to End a Month-to-Month Tenancy Template

What a California notice to end a month-to-month tenancy must include under California law, and a fill-in draft that follows those rules.

What California law requires

Written notice. Either party may end a month-to-month tenancy with at least 30 days' notice. A landlord must give 60 days' notice if the tenant has lived in the unit 1 year or more, or 30 days if less than a year or in certain sales to an owner-occupant buyer. The notice may be served by any CCP 1162 method (personal delivery, substituted service plus mailing, or posting plus mailing) or by certified or registered mail. A landlord's notice must include, in substantially this form, the statutory statement that state law permits former tenants to reclaim abandoned personal property, subject to conditions and storage costs. The landlord may not charge a fee for serving or delivering the notice. Under the Tenant Protection Act, a landlord of a covered unit where the tenant has lived 12 months or more also needs a just cause, stated in the notice.

Fill-in draft

Replace every [bracketed] item. If your state or city requires specific wording, a specific form, or a translated version, that requirement controls over this draft. Courts dismiss eviction cases over defective notices — if anything is unclear, talk to a lawyer.
