Jury Duty Excuse Letter in Colorado

A short letter asking the court to excuse you from jury duty or postpone it. Follow the instructions on your summons first, because courts handle these requests differently, and keep following the summons until the court answers.

What Colorado law says

Who can be excused from jury dutyColorado has no age-based exemption; jurors must be at least 18. You are not qualified if you served on a jury in any court in the past 12 months, or if you are the primary caregiver for a permanently disabled person in your household and do not work outside the home; a physical or mental disability that prevents service also disqualifies you, with a current statement from a licensed physician, physician assistant, advanced practice nurse or authorized Christian Science practitioner. Breastfeeding mothers can be temporarily excused, usually for one year. Military members and students are not automatically excused but may postpone (military up to 6 months; out-of-state students up to 12 months), and everyone has the right to one postponement, requested on the summons form, online through the county's jury page, or by contacting the jury commissioner. A felony conviction does not bar trial jury service but does bar grand jury service.

Jury duty pay and your jobColorado employers must pay regularly employed jurors (including part-time or temporary workers on a set schedule for the three months before service) their regular wages, up to $50 per day unless they agree to more, for the first three days of jury service; after the third day, the state pays every juror $50 per day. A court excuses an employer (or a self-employed juror) from paying upon a finding of financial hardship, and the state then pays up to $50 per day for those first days. Employers may not fire, harass, threaten or coerce an employee or take away benefits because of a summons or jury service; a juror may sue an employer who fails to pay or retaliates, with treble damages and attorney's fees possible for willful misconduct, and willful harassment of a juror by an employer is a class 2 misdemeanor.
