Warranty Deed in Colorado
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Colorado law says
| Signing and recording a deed | A deed acknowledged before a notary or other proper official substantially in the statutory form is prima facie evidence that it was properly signed, and an unacknowledged or defectively acknowledged deed that has been recorded for ten years is treated as properly acknowledged. Deeds are recorded with the county clerk and recorder where the property is located, and an unrecorded deed is not valid against a later buyer who records first (a race-notice rule). Deeds must include the property's street address, if one is displayed, next to the legal description. Text from the Colorado Revised Statutes 2024 edition; later session laws may have changed it. |
