Warranty Deed in Florida
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Florida law says
| Signing and recording a deed | A deed must be signed in the presence of two subscribing witnesses. To be recorded it must be acknowledged before a notary (or other officer) or proved by a witness. The clerk will not record it unless it shows the printed names and addresses of the signers, witnesses and grantees, the notary's name, the name and address of the person who prepared it, and a blank 3-by-3-inch space at the top right of page 1. Documentary stamp tax applies at 70 cents per $100 of consideration. Witness rule: https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0600-0699/0689/0689.html. The recording rules in § 695.26 do not apply to instruments executed outside Florida. |

| Signing and recording a deed | A deed must be in writing and signed by the grantor in the presence of two subscribing witnesses (witnessing by audio-video technology is allowed where the statute permits). To be recorded, the grantor's signature must be acknowledged before a notary public or other authorized official. The recording clerk requires each signer's and witness's name printed beneath the signature with a post-office address, the grantee's name and address, and the name and address of the person who prepared the deed. Deeds are recorded with the Clerk of the Circuit Court in the county where the land is located. Documentary stamp tax applies at 70 cents per $100 of consideration. Miami-Dade County uses a different documentary stamp rate for some property. |
