Hialeah Landlord-Tenant Rules
Hialeah adds local rules on top of Florida landlord-tenant law. Here is what is different, with the city code or agency page behind each rule.
| State preemption of local tenant rules | Florida reserves the regulation of residential tenancies and the landlord-tenant relationship to the state. Its 2023 law supersedes local rules on matters covered by the Florida Residential Landlord and Tenant Act, including tenant screening, security deposits, rental fees, lease terms, disclosures and notice requirements. Cities also may not adopt any measure that has the effect of imposing controls on rents. For nearly every landlord-tenant question, state law (see the Florida page) applies. | Local rental assistance (eviction prevention) | Hialeah's Housing and Community Services Division offers temporary SHIP rental assistance that may cover first or last month's rent, a security deposit, eviction prevention or rapid rehousing for households that meet income and program rules. Federal ESG homelessness-prevention and rapid-rehousing help is run through Hermanos de la Calle, which does its own intake. Call 305-883-8040 to start; staff do an initial review and may refer you. Help depends on funding and is not guaranteed; the pandemic-era Emergency Rental Assistance Program is closed. The page does not list income limits, residency rules or dollar amounts. | Habitability/code enforcement & complaint line | Hialeah's Code Compliance Division enforces City ordinances on property maintenance, zoning and public safety across eight city sectors. Report a problem at 305-883-5832, codecompliance@hialeahfl.gov, or the City's online Report an Issue tool (501 Palm Ave., 2nd floor). | Fair housing | The City's fair housing page lists only the federal protected classes, and the City's Housing and Community Services Division does not investigate fair housing complaints. It refers people to HUD's Office of Fair Housing and Equal Opportunity, 1-800-669-9777. Source: Official source |
Eviction cases in Hialeah are heard in: Miami-Dade County Court (11th Judicial Circuit); landlord-tenant cases must be filed in the court district where the property is located, and clerks at the Miami-Dade Justice Center or the district courts can help find the right one
