Warranty Deed in Georgia

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What Georgia law says

Signing and recording a deedA deed must be in writing, signed by the grantor, and attested by an officer (such as a notary public, judge, magistrate or court clerk) plus one other witness. To be recorded it must be an original, and the name and mailing address of the person it should be returned to must be printed, typed or stamped at the top of the first page. Georgia's real estate transfer tax is $1.00 for the first $1,000 of value plus 10 cents for each additional $100, on transfers over $100, excluding pre-existing liens not removed by the sale.

Signing and recording a deedA deed to land must be in writing, signed by the grantor, and attested by two witnesses: an officer (such as a notary public, a judge of a court of record, or a court clerk) and a second, unofficial witness. It must be delivered to the buyer. Notaries and judges of courts of record may attest anywhere; other officers only in their own county.
Recording office, transfer tax and transfer form rules are set in other sections. Official code not freely readable online; text verified on a public code mirror (code year 2024).
