Warranty Deed in Illinois

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What Illinois law says

Signing and recording a deedWhen a deed is recorded, the buyer and seller must file Form PTAX-203, Illinois Real Estate Transfer Declaration (with any required documents), with the deed at the county recorder's office, unless the transfer is exempt, in which case an exemption notation goes on the face of the deed. The state real estate transfer tax is $0.50 for each $500 of value or fraction thereof; counties and home-rule cities may add their own tax.

Signing and recording a deedA deed must be in writing and signed by the grantor, who must be of full age and sound mind. Deeds may be acknowledged before a notary public (with official seal) or other listed officer. Illinois imposes a state real estate transfer tax of 50 cents per $500 of value, based on the transfer declaration that must be filed with the transfer.
Some counties and cities add their own transfer taxes, and some transfers are exempt; check with the county recorder.
