Warranty Deed in Indiana
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Indiana law says
| Signing and recording a deed | Whenever a deed or other conveyance document for real property sold for valuable consideration is filed, a Sales Disclosure Form (State Form 46021) completed by the buyer and seller must go with it. The county auditor may not accept the conveyance if the form is missing, incomplete, or not stamped by the county assessor. The filer pays a $20 fee to the county auditor, except for certain transfers such as to a charity or compulsory transfers (foreclosure, divorce, court order, condemnation or probate). A separate form is generally required for each parcel. |

| Signing and recording a deed | To be recorded, a deed must carry an acknowledgment or a proof performed by a notarial officer (an acknowledgment may also be taken by a remote notary public) and meet the notarial and county recording requirements. A conveyance must also include a statement of the mailing address for property tax statements and the grantee's mailing address (a street or rural route address). Deeds are recorded with the county recorder where the land is located. County recording rules (such as county auditor endorsement and a sales disclosure form for many transfers) are set in other sections. Re-verified and corrected 2026-10-27. Source: IC 32-21-2-3 |
