Warranty Deed in Iowa
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Iowa law says
| Signing and recording a deed | A deed must be acknowledged under Iowa's notary law (chapter 9B) to be lawfully recorded; if the grantor dies or will not acknowledge, execution can be proved by one competent witness. When a deed is recorded, a declaration of value signed by a buyer or seller (or agent) must be submitted to the county recorder. The state real estate transfer tax is 80 cents for each $500 (or fraction) of consideration over $500. Transfer tax and declaration: https://www.legis.iowa.gov/docs/code/428A.pdf. Certain transfers are exempt (§ 428A.2). |

| Signing and recording a deed | A deed must be acknowledged before a notary or other notarial officer (Iowa Code chapter 9B) to be recorded. It is recorded with the county recorder of the county where the land is located; an unrecorded deed is not valid against later buyers who pay value without notice. A declaration of value signed by a seller or buyer is submitted when most deeds are recorded. Iowa's real estate transfer tax is 80 cents per $500 of consideration over $500; deeds with no consideration, deeds between spouses or parent and child without consideration, and deeds distributing estate assets to heirs or devisees are among the exemptions. |
