Pet Addendum in Kansas
Adds pet terms to a lease. Assistance animals for people with disabilities are not pets: no pet fee or pet rent may be charged for them under federal fair housing rules.
What Kansas law says
| Pet deposits and fees | If the lease allows pets, the landlord may collect an additional security deposit of up to one-half of one month's rent, on top of the regular cap (one month's rent unfurnished; 1½ months' rent furnished). The pet deposit is a security deposit subject to the same return rules. The statute does not separately address non-refundable pet fees or monthly pet rent. Source: K.S.A. 58-2550(a) |

| Service & support animals (state law) | Kansas has no statute specific to emotional support animals in housing. By statute, a person with a guide, hearing assistance, or service dog (a dog specially selected, trained, and tested) has the right to be accompanied by it in acquiring and using rental housing without an extra charge, but is liable for damage the dog causes. A dog present only for comfort, protection, or personal defense is not an assistance dog under state law. Falsely claiming the right to be accompanied by an assistance dog in the places listed in K.S.A. 39-1101, or claiming a disability to acquire an assistance dog, is a class A nonperson misdemeanor. ESA requests are handled under federal and state fair-housing reasonable-accommodation rules. Guide dogs (39-1102), hearing assistance dogs (39-1107, amended 2022) and service dogs (39-1108) each carry the same rental-housing right. A pet deposit (up to one-half month's rent) is allowed only where the lease permits pets (K.S.A. 58-2550(a)); federal law generally bars pet deposits for assistance animals. |
