Warranty Deed in Louisiana
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Louisiana law says
| Signing and recording a deed | A transfer of land must be made by 'authentic act' or by 'act under private signature' (Civil Code arts. 1839, 2440). An authentic act is signed before a notary and two witnesses, with each party, witness and notary signing and their names printed under the signatures (art. 1833). An act under private signature can be 'duly acknowledged' by the party before a notary or court in the presence of two witnesses (art. 1836). A sale of land binds the parties when made but does not affect third persons until it is filed for registry in the parish where the property is located (arts. 1839, 2442). |
