Warranty Deed in Maine
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Maine law says
| Signing and recording a deed | Before a deed can be recorded at the registry of deeds, it must be acknowledged by the grantor (or one of them, or their attorney) before a notary public or a Maine attorney, or other listed officers; an acknowledgment meeting the Revised Uniform Law on Notarial Acts must be accepted (33 M.R.S. §203). A deed offered for recording must be accompanied by a declaration of value on the State Tax Assessor's form, showing the tax map and parcel number (and taxpayer ID numbers for business grantors and grantees) and, if exempt from transfer tax, the reason (36 M.R.S. §4641-D). The transfer tax rate was not read for this entry. |

| Signing and recording a deed | A deed must be acknowledged (notarized) by the grantor before a notary public, a Maine attorney, or another authorized officer before it can be recorded. It must be recorded in the registry of deeds for the county where the land lies to be effective against third parties. Most deeds must be accompanied by a declaration of value, and a real estate transfer tax of $2.20 per $500 of value is charged (split equally between grantor and grantee), with an extra $3.80 per $500 on value over $1,000,000.
