Maryland Notice to End a Month-to-Month Tenancy Template

What a Maryland notice to end a month-to-month tenancy must include under Maryland law, and a fill-in draft that follows those rules.

What Maryland law requires

Written notice of intent to end the tenancy: 60 days before the end of a month-to-month tenancy or a written lease longer than 1 week. Year-to-year tenancies need 90 days. Week-to-week tenancies need 7 days with a written lease, 21 days without one. Shorter periods (30 days for month-to-month) apply in the foreclosure situation in § 8-402(c)(4), which does not apply in Baltimore City, Montgomery County, or to landlords with 5 or more units. A lease may not shorten the legal notice period. Accepting payment after the notice does not waive it unless agreed in writing.

The parts of § 8-402 reviewed do not set a delivery method for this notice. Local law (such as Montgomery County or Baltimore City) may add requirements.

Fill-in draft

Replace every [bracketed] item. If your state or city requires specific wording, a specific form, or a translated version, that requirement controls over this draft. Courts dismiss eviction cases over defective notices — if anything is unclear, talk to a lawyer.
