Warranty Deed in Maryland
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Maryland law says
| Signing and recording a deed | A deed naming the grantor and grantee, describing the property with reasonable certainty, and stating the interest granted is sufficient if executed, acknowledged and, where required, recorded (Real Prop. §4-101). A deed (other than a mortgage or deed of trust and similar instruments) may not be recorded unless it bears a certification by a Maryland attorney that the attorney prepared it or supervised its preparation, or a certification by a party named in the deed that the party prepared it. Each instrument offered for recording must be accompanied by a complete intake sheet on the form provided by the Administrative Office of the Courts (or be endorsed by the assessment office), and property generally cannot be transferred on the tax records until current taxes and charges are paid (§3-104). |

| Signing and recording a deed | A deed must name the grantor and grantee, describe the property with reasonable certainty, state the interest granted, and be executed and acknowledged (notarized). It is recorded with the Clerk of the Circuit Court (land records) in the county where the property is located, accompanied by a completed intake sheet, with the county tax collector's certificate that current property taxes have been paid. Each signer's name must be typed or printed under the signature. State and county transfer and recordation taxes generally apply when a deed is recorded; rates and exemptions vary by county. Recording rules: § 3-104 (https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=grp§ion=3-104&enactments=false). |
