Warranty Deed in Missouri

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What Missouri law says

Signing and recording a deedRecorders must record deeds that have been proved or acknowledged (RSMo 59.330). A deed must contain a legal description of the land and the mailing address of one of the grantees, or the recorder will not record it (59.330.2). The recorder may refuse documents that do not meet format rules, including at least 8-point type in dark ink, white or light paper of at least 20-pound weight, each signature in dark ink with the name typed or printed beneath it, and a 3-inch top margin on the first page (59.310). RSMo 442.210 sets the form of the certificate of acknowledgment.
Signing and recording a deedA deed must be signed by the grantor (or a lawful agent), acknowledged before a notary public or other authorized officer, and state whether each individual grantor is married or unmarried. It is recorded with the county recorder of deeds; the first page must show the title, date, grantor names and marital status, grantee names, statutory addresses and legal description, with a 3-inch top margin.
No state real estate transfer tax provision was identified in the sections reviewed.
