Nebraska Residential Lease Agreement
A free Nebraska lease template, plus what Nebraska law requires a lease to include, attach or leave out — each with the statute. Use it as a starting point; landlords with unusual situations should have a lawyer review the final lease.
Disclosures Nebraska requires
| Owner and manager name and address | At or before the start of the tenancy, the landlord must disclose in writing the name and address of the person managing the premises and of an owner or the owner's agent for service of process and receiving notices and demands. It must be kept current and binds successors. A person who fails to disclose becomes the landlord's agent for service, notices and landlord duties. Applies to: All residential rental agreements Source: Neb. Rev. Stat. § 76-1417 |

Terms Nebraska law requires or controls
| Default terms when the lease is silent | If the lease does not say otherwise: the tenant pays fair rental value; rent is paid at the dwelling unit; rent for a term of one month or less is due at the start of the term, otherwise in equal monthly installments at the start of each month; rent is prorated day to day; and a tenancy with no fixed term is week to week for a weekly-paying roomer and month to month otherwise. Rent is due without demand. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1414 |
|---|---|
| Contact person if the tenant dies | On the landlord's request, the tenant may name (and keep current) a person authorized to enter and retrieve the tenant's belongings if the tenant dies. The landlord must try to contact that person within 10 days of the death; the person then has 20 days to say they will claim the property and 20 more days to remove it. Applies to: All residential leases (optional designation) Source: Neb. Rev. Stat. § 76-1414(5) |
| House rules | Landlord rules on use and occupancy are enforceable only if they serve tenant welfare, protect the property from abuse or fairly distribute services; are reasonably related to that purpose; apply fairly to all tenants; are clear enough to follow; are not meant to evade the landlord's duties; and the tenant had notice of them when signing. Rules adopted later are enforceable only with reasonable notice and if they do not substantially change the bargain. Applies to: All residential leases with rules or regulations Source: Neb. Rev. Stat. § 76-1422 |
Clauses that are void in Nebraska
| Waiver of rights | A rental agreement may not require the tenant to waive rights or remedies under the Uniform Residential Landlord and Tenant Act. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1415 |
|---|---|
| Confession of judgment | A rental agreement may not authorize anyone to confess judgment on a claim arising from the agreement. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1415 |
| Attorney's fees | A rental agreement may not require the tenant to pay the landlord's or the tenant's attorney's fees. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1415 |
| Landlord liability limits and indemnity | A rental agreement may not limit the landlord's liability for active and actionable negligence or require the tenant to indemnify the landlord for that liability or its costs. Prohibited provisions are unenforceable; if a landlord knowingly and deliberately uses a lease containing them, the tenant may recover actual damages and reasonable attorney's fees. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1415 |
| Deposits above the cap | A landlord may not demand or receive security deposits, however labeled, above one month's periodic rent, plus a pet deposit of no more than one-fourth of one month's rent. Housing agencies under the Nebraska Housing Agency Act are exempt from the caps. Applies to: All residential leases Source: Neb. Rev. Stat. § 76-1416 |
