Itemized deductionsRequired: a written itemization of the amounts withheld must accompany the returned balance within 14 days.
Penalty for withholdingTenant recovers the money due plus court costs and reasonable attorney's fees; if the landlord's failure was willful and not in good faith, also liquidated damages equal to the lesser of one month's periodic rent or two times the deposit.
Wear and tear / move-out chargesNot defined by statute. At move-out the tenant must leave the unit as clean as when the tenancy began, 'excepting ordinary wear and tear.' The landlord may apply the deposit only to unpaid rent and damages caused by the tenant's noncompliance with the lease or with the tenant's statutory duties.
