Warranty Deed in New Hampshire

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What New Hampshire law says

Signing and recording a deedA deed must be signed by the grantor, acknowledged before a justice, notary public, or commissioner, and show the grantee's mailing address. An unrecorded or unacknowledged deed is valid only against the grantor and heirs. The real estate transfer tax is $0.75 per $100 of the price (minimum $20 when the price is $4,000 or less), charged to both the buyer and the seller. Buyer and seller must each file a separate declaration of consideration with the Department of Revenue Administration within 30 days after the deed is recorded.
Deeds acknowledged and recorded since August 15, 1981, that were not attested by a witness are considered valid (RSA 477:7). Transfer tax: https://gc.nh.gov/rsa/html/V/78-B/78-B-1.htm. Failure to file the declaration does not cloud title.
