Warranty Deed in New Mexico
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What New Mexico law says
| Signing and recording a deed | A deed must be signed by the person transferring the property (or their legal agent or attorney). To be filed and recorded, the deed must be acknowledged, meaning notarized by a person authorized under the Revised Uniform Law on Notarial Acts; an unacknowledged instrument may not be recorded or considered of record. The statute's sample warranty and quitclaim deed forms state the grantee's address and call for an acknowledgment. Chapter 14: https://nmonesource.com/nmos/nmsa-unanno/en/item/18514/index.do. |

It must be acknowledged before a notary to be recorded, and is recorded with the county clerk of the county where the land is. For residential property, a residential property transfer affidavit must be filed with the county assessor within 30 days of recording, with exceptions (for example, gifts, estate distributions, and transfers between spouses or parent and child for nominal consideration).
