What New York law says
| Notice before a rent increase | Written notice is required if the landlord will not renew or will raise the rent by 5% or more. The notice period depends on the longer of how long the tenant has lived there or the lease term: 30 days if under 1 year; 60 days if 1 to 2 years; 90 days if more than 2 years. If the landlord gives late notice, the tenancy continues on the existing terms until the full notice period has run. Since Aug. 18, 2024, the notice must include the RPL § 231-c good-cause statement (whether the unit is covered, the basis for non-renewal, and justification for increases above the local rent standard). Source: N.Y. Real Prop. Law § 226-c |
|---|---|
| Rent control / increase limits | Local rent control/stabilization allowed. Rent stabilization covers many NYC buildings and other localities that declare a housing emergency (allowed statewide since June 15, 2019). Good Cause Eviction Law (RPL Art. 6-A, 2024) applies automatically in NYC and in localities that opt in: rent increases above the 'local rent standard' (5% + regional CPI, capped at 10%) are presumed unreasonable and eviction/non-renewal requires good cause. |
