Warranty Deed in New York
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What New York law says
| Signing and recording a deed | To be recorded, a deed must be acknowledged by the person signing it (or proved as the statute requires), with the acknowledgment certified, and recorded with the county clerk (or city register) where the property lies; an unrecorded deed is void against a later good-faith buyer who records first. New York's real estate transfer tax is $2 per $500 of consideration (over $500), generally paid by the seller; a 1% 'mansion tax' paid by the buyer applies to residences of $1 million or more. Form TP-584 (TP-584-NYC in New York City) and payment are due within 15 days after delivery of the deed, filed with the county clerk outside NYC. Transfer tax page (updated June 1, 2026): https://www.tax.ny.gov/bus/transfer/rptidx.htm. Higher additional rates apply to certain New York City conveyances of $2 million or more. The county clerk mails a notice to the owner of record when a residential conveyance is recorded. |
