Unemployment Appeal Letter in North Carolina
A letter appealing a denial of unemployment benefits. Appeal deadlines are short and strict in every state — file before the deadline shown below, even if you are still gathering documents, and keep claiming benefits each week while the appeal is pending if your state allows it.
What North Carolina law says
| Appealing a denial | An adjudicator's decision becomes final unless you file a written appeal within 30 days after the date of notification or mailing, whichever is earlier. An appeals referee's decision can be appealed to the Board of Review within 10 days. Follow the appeal instructions and deadline printed on your determination letter. |

| If you were fired | You are disqualified if you are unemployed because of misconduct connected with the work: willful or wanton disregard of the employer's interest, such as deliberately violating standards of behavior the employer can expect or has explained to you, or carelessness or negligence so serious or repeated that it shows intentional disregard of the employer's interests. Examples presumed to be misconduct (which you can rebut) include violating a written drug or alcohol policy, reporting to work impaired, physical violence connected with work, theft, falsifying employment documents, violating a written absenteeism policy, and refusing or failing to perform assigned work after at least three written reprimands in the prior 12 months. | If you quit | You are disqualified if you left work for a reason other than good cause attributable to the employer, and you must prove good cause. Leaving because of a permanent, unilateral cut of more than 50% in your scheduled full-time hours, or more than 15% in your rate of pay, is presumed to be good cause attributable to the employer, unless the employer shows the cut was temporary or caused by your own conduct.
