Warranty Deed in North Dakota

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What North Dakota law says

Signing and recording a deedA deed signed by an individual must be acknowledged before a notary or other authorized officer (or proved by a subscribing witness) to be recorded, with original signatures; no witnesses are required when it is acknowledged. The deed must show each grantee's post-office address (and street address within a city), and a deed with a metes-and-bounds description must state who prepared the legal description. The recorder will not record it without the county auditor's certificate of transfer, and the grantee must certify on the deed the full consideration paid or a listed exemption (quitclaim deeds and family transfers are among the exemptions).
