Warranty Deed in Ohio
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Ohio law says
| Signing and recording a deed | The grantor must sign the deed and acknowledge the signature before a notary public (or a judge, court clerk, county auditor, county engineer or mayor), who certifies the acknowledgment; the current statute does not call for witnesses. Before the county auditor endorses the transfer, the buyer (grantee) must file a statement of value on the tax commissioner's form, or a statement of the reason the transfer is exempt. The county charges a real property conveyance fee on transfers. | Signing and recording a deed | A deed must be signed by the grantor and acknowledged before a notary public, a judge or clerk of an Ohio court of record, a county auditor or engineer, or a mayor. Witnesses are not required. Before recording, the grantee files a statement of the value of the property conveyed with the county auditor on the form prescribed by the tax commissioner; the deed is then recorded with the county recorder. The conveyance fee rate is set by statute and county resolution and varies by county. Source: Ohio Rev. Code 5301.01; 319.202 |
