Warranty Deed in Oklahoma
A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.
What Oklahoma law says
| Signing and recording a deed | A deed is valid between the parties without acknowledgment, but it is not valid against third persons, and the county clerk will not record it, unless it is signed and acknowledged (notarized) in substantial compliance with the deeds chapter. A documentary stamp tax applies to deeds of realty that is sold for more than $100, at 75 cents per $500 of consideration or fraction of $500 (excluding liens that remain on the property). Deeds are recorded with the county clerk in the county where the land lies. Documentary stamp tax: https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os68.pdf |

| Signing and recording a deed | A deed must be in writing and signed by the grantor. No subscribing witness is needed. To be recorded, a deed must be executed and acknowledged in substantial compliance with the statutes (acknowledged before a notary or other authorized officer), and an unrecorded or unacknowledged deed is not valid against third parties. Deeds are recorded with the county clerk of the county where the land is located. The statutes include short forms for warranty and quitclaim deeds. A documentary stamp tax of $0.75 per $500 of consideration (or fraction) applies to deeds for realty that is sold when the consideration exceeds $100; it does not apply to conveyances that are not sales. Exemptions from the documentary stamp tax are listed in 68 O.S. § 3202. |
