How to Evict a Roommate in Oklahoma (and Other Household Situations)

What Oklahoma law says about roommates who are not on the lease, guests who won't leave, family members, renting a room in your own home, and tenancies at will — each with the statute or official source.

Short answer: A tenant is any person entitled under a rental agreement to occupy a dwelling unit. An occupant who has no rental agreement with the landlord, and with whom the landlord has not consented to create a tenancy, is not a tenant: the landlord may demand that the occupant leave without filing an eviction case, and an occupant who wrongfully fails to leave within a reasonable time commits trespass (fine up to $500). Separately, any person in possession of real property with the owner's assent is presumed to be a tenant at will unless shown otherwise, so landlord consent is the key question. 41 O.S. §§ 1, 102(15), 111(G)

Roommate not on the leaseA tenant is any person entitled under a rental agreement to occupy a dwelling unit.
A rental agreement may also set reasonable limits on use by occupants; an occupant who breaches an enforceable lease condition must leave on the landlord's written request (41 O.S. § 117(B)).
Removing a roommate or subtenantNo roommate-specific statute. A month-to-month tenancy or tenancy at will is ended by written notice at least 30 days before the termination date (7 days for tenancies shorter than month-to-month), served personally, or on a family member over 12 living with the tenant, or by posting plus certified mail. If the person stays without consent after termination, an action for possession is filed in court.
Whether a tenant (rather than the landlord) can use this procedure against a roommate depends on whether a rental agreement exists between them.
Guests who won't leaveA guest becomes a tenant only through a rental agreement or the landlord's consent to a tenancy. For an occupant with no rental agreement and no landlord consent, the landlord may demand that they leave and is not required to start eviction proceedings; failing to leave within a reasonable time is trespass. Note that a person in possession with the owner's assent is presumed to be a tenant at will.
Renting a room in your own home (lodgers)Oklahoma defines a 'roomer' or 'boarder' as a tenant occupying a unit that lacks at least one major bathroom or kitchen facility, in a building where those facilities are shared and in which the landlord lives. Roomers and boarders are tenants under the Residential Landlord and Tenant Act; unless a written agreement fixes a definite term, a roomer or boarder paying weekly rent has a week-to-week tenancy, ended with at least 7 days' written notice.
Tenancy at willAny person in possession of real property with the owner's assent is presumed to be a tenant at will unless the contrary is shown; a tenant who stays after a lease of one or more years with the landlord's assent is also a tenant at will. Either the landlord or the tenant may end a tenancy at will (or month-to-month) with written notice at least 30 days before the termination date, counted from service.
Hotel and extended-stay guestsTransient occupancy in a hotel, motel, or other similar lodging is not governed by Oklahoma's Residential Landlord and Tenant Act regardless of the length of the stay (unless the arrangement was created to avoid the Act).
The words 'regardless of the length of the stay' were added in 2023 (Laws 2023, c. 159, eff. Nov. 1, 2023).

Never remove someone by changing the locks or taking their belongings: if the person has become a tenant, only a court can order them out. If there is violence or a threat, call 911 and ask about a protective order.
