Sublease Agreement in Oregon

For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.

What Oregon law says

Subletting rulesNo statute — lease controls for ordinary rentals. The Residential Landlord and Tenant Act does not set a consent standard for subletting or assignment. If the tenant has moved out, the lease prohibited subleasing or other occupants without the landlord's written permission, and the landlord has not knowingly accepted rent from the occupant, the landlord can remove the unauthorized occupant after at least 24 hours' written notice and a court eviction action.
Manufactured dwelling and floating home park tenants have a separate subleasing statute (ORS 90.555).
