Sublease Agreement in Pennsylvania
For a tenant renting their unit, or part of it, to a subtenant. Most leases require the landlord's written consent first — get it, and attach it.
What Pennsylvania law says
| Subletting rules | No statute — lease controls. The Landlord and Tenant Act does not set a landlord-consent standard for subletting; whether a tenant may sublease is up to the lease. The Act requires only that a lease for a term of more than 3 years be assigned or surrendered in a signed writing (unless by operation of law). The Pennsylvania Attorney General's tenant guide advises checking the lease for whether you can sublease: https://www.attorneygeneral.gov/wp-content/uploads/ConsumerTenant-Landlord-Guide.pdf |
