Warranty Deed in South Carolina

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What South Carolina law says

Signing and recording a deedBefore a deed can be recorded it must be proved by a subscribing witness's affidavit, acknowledged under the Uniform Recognition of Acknowledgments Act, or signed and acknowledged in the presence of two witnesses before an officer authorized to administer oaths. The deed must show the grantee's mailing address and include a derivation clause naming where the grantor's title came from (quitclaim and non-warranty deeds are exempt from the derivation clause). A deed recording fee of $1.85 per $500 of value (or fraction) is charged, normally paid by the grantor, and the register of deeds requires an affidavit stating the property's value or the reason for an exemption.
