Resignation Letter in South Dakota

A simple resignation letter you can adapt for immediate resignation or a longer notice period. Your state's final-paycheck and PTO-payout rules are shown below.

What South Dakota law says

Final paycheck if you quitDue no later than the next regular payday for the period worked, or once the employee returns all company property, whichever is later.
Unused vacation / PTO payoutNo state law requires paid leave or its payout. Whether vacation pay is paid at separation (for example, when an employee leaves without two weeks' notice) depends on the agreement between employer and employee.
At-will employment and exceptionsEmployment with no set term may be ended at the will of either side on notice. Exceptions recognized include: a contract for a set length of employment; firing in retaliation for refusing to commit a crime or unlawful act; firing for using a legal right, such as filing a workers' compensation claim; discrimination based on race, color, creed, religion, sex, ancestry, disability or national origin; firing for jury service; and firing for lawful tobacco use off the job during non-working hours (with limited exceptions).
