Warranty Deed in South Dakota

A warranty deed transfers real estate with the seller's promise that the title is good. Before you record it, check your state's signing and recording rules below and your county recorder's formatting rules (margins, preparer and return-address blocks, transfer-tax forms) — recorders reject deeds that miss them.

What South Dakota law says

Signing and recording a deedBefore a deed can be recorded with the county register of deeds, the person signing must acknowledge it (or its execution must be proved as the law allows); an unrecorded deed is still valid between the parties and anyone with notice. A real estate transfer fee of 50 cents per $500 of value (or fraction) is imposed on transfers of title and is paid by the grantor; listed transfers are exempt, such as transfers between spouses or parent and child for nominal consideration.

Signing and recording a deedBefore a deed can be recorded, the person signing it must acknowledge it (for example, before a notary public), or its execution must be proved as provided by law. Deeds are recorded with the register of deeds of the county where the land is located. A real estate transfer fee of 50 cents per $500 of value (or fraction) is paid by the grantor and collected by the register of deeds; exemptions include absolute gifts, transfers for no consideration, nominal-consideration transfers between spouses or between parent and child, and transfers under a decree of distribution in an estate. A Certificate of Real Estate Value (Form PT 56) must be filed with any deed (including quitclaim deeds); probate decrees are exempt.
